Love-making by a married man with a woman after making her believe that he was unmarried or on the promise of marriage is rape, the Supreme Court has ruled.

You don't seem to realise how serious lying in a relationship can be. It shatters people and being cheated has serious implications on health too, mostly emotional. Just like a rape victim goes through the shame and humiliation for years if not their entire lives, cheated lovers (those who were conned to give sexual consent by the promise of marriage) also goes through similar trauma.

Alain - I have been lied to. I have had a woman say she will marry me. I have turned my life upside down to please her and for a future with her. Then she has discarded me. With no reasons.
Do not tell me I do not understand lies in a relationship. No offence has been taken, but you do not know me.
I have been lied to for other’s pleasure. I am a man. Does this mean I am unable to feel pain in this situation ?
I would not take someone to court over it.

I agree with Alain. I would rather go one step further and suggest that the same law applies to women who cheat. It is equally humiliating for an innocent unsuspecting man to be conned into having sex by a woman who promised to marry him and later dumped him.

It should be either yes or no. I do agree with SC’s decision; it’s a right one.

Alain and Moses, I agree that there should be equality in punishments and cheating someone to have sex on the pretext of getting married later is a grave sin. But how is rape defined? The definition of rape varies from country to country. In India only the act of penile insertion in the vagina of an non-consenting female is rape. There is nothing other than outraging modesty or causing bodily injury if the act involves anal intercourse or using objects or digits. Men cannot technically report rape and so cannot a forcibly sodomized female.

The Indian Supreme Court has gone mad. This is something many judges would have differences on. I am saying so because take for example if I promised my lover that I shall marry her someday and then for a reason I cannot like I don't have a job yet, or don't have the money or I find the girl cheating me. Now she can take me to the court and file a rape complaint. This is ridiculous.

This is an ironic judgement by some moronic blokes in black in India. Rape by mutual consent is an unheard of thing. You can't have a nice time based on a promise and then when the promise is broken cry rape.

It feels the most easy ways to comment on the honorable Supreme Court of India that the decision was a foolish one or they don’t think before they pass judgments....but guys...there are certain things we must understand...firstly, all cases are handled on individual circumstances and on case to case basis....so if there is one decision where even consented sex is taken as rape...there are several instances where even murder is exempt from punishment...in case a promise is done and some action is taken over that promise, and later the promise turns out to be a fake one...what is the remedy available for the person who acted on the promise?? treat is like a case of ready made garments, if it claims that there is a guarantee of colour or stitching for say 6 months...and for that they take a higher price...and you purchase that item...after two weeks, if the stitches are gone or colours fade, and the company refuses to act uponw the promise, we will just run towards Consumer courts for help...and we get satisfied...but what about a girl, who’s lost her virginity on the basis of a fake promise...she can’t run to any court and get her virginity back....and thus in this case, if damages can’t be repaired, the accused must be penalized...and this is what honorable Supreme Court has done....I don’t find anything bad in the decision....but a new direction being given to the legal system....

I respect SC’s decision, but I won’t favour it. Until I get assurance that the same will be applicable to women folk.
Just now I was discussing the same with a (male) friend of mine, and we shared a very intimate part of our personal lives, where we were practically fooled by girls into believing that they would marry us.

Such a ruling can result in grievous judgements in future and can be exploited by many. To say this also means women don’t desire for sex and and it is all the man’s fault. I can’t but disagree with such a weird ruling.

You comparing readymade garments with virginity??? Ah ha! Okay then. Let me tell you something for the sake of argument. They garments can be stitched back free of cost if the stitches break within the warranty period. A maidenhead can also be 'stitched' back.
Maybe the court should have put the cost of such a tailoring on the man. Logical right?

What NONSENSE?! Where does the virginity factor comes from? And who knows whether the girl in question was a virgin or not? Did she have a certificate proving that she was a virgin before the man deflowered her on a promise? And if she had a certificate, who issued it?

While all this argument about what constitutes a rape and morality issues is fine, I still would like to know hoe this will actually ever work. Lets say I promise someone that i will marry them and then sleep with them and then do not marry the girl. Now how is she ever going to prove it unless i promise in public???
and will any idiot who is contemplating cheating on someone promise in public??? So the court is going to go on the girl’s word??? This is absolute legal nightmare. No Proof means no Crime done and thats that.

I think that a ruling such as this diminishes the reality of the victims of a true, physical rape.
To call the 2 equal (married man lying and a physical rape) by labelling them both rape is wrong.

Not exactly. If the girl is not forced to have sex, it’s not rape. Because girls are also equally interested in it even before marriage (in many cases). And sometimes that encourages real sex between the two, even if no promise is made about marriage.
In this modern society, many of the girls themselves indulge in sexual activities with their boyfriend. Later they feel guilty of it and blame their boyfriends calling it rape.

I imagine that there would have to be a lot of US senators and judges a little worried about their personal lives, after this precedent...
But in the end - people lie in relationships. Will that become a felony offence soon too ?
